1. About nabu.co.uk

The website is operated by nabu baby.

Please note that we accept orders as agents on behalf of our sellers. The resulting legal contract is between you and that seller, and is subject, in addition to these Terms & Conditions to the terms and conditions of that seller, which they will advise you of directly.

We cannot give any undertaking, that goods or services you purchase from sellers through the website will be of satisfactory quality, and any such warranties are disclaimed by us absolutely. This disclaimer does not affect your statutory rights against the seller.

Each order you place shall be deemed to be an offer by you to purchase the goods specified within it subject to these Terms & Conditions and any additional terms and conditions notified to you by the seller. The contract will relate only to those goods notified in the email order acknowledgement from nabu.co.uk.

Where you order goods or services through the website we may disclose your customer information related to that transaction to the relevant seller.

Please note that, products offered for sale by nabu.co.uk sellers are directed solely at UK residents.

At no time do we hold any items offered for sale through the website.

2. Accessing nabu.co.uk

Access to the website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the website without notice. We will not be liable if for any reason the website is unavailable at any time or for any period.

From time to time, access to some parts of the website may be restricted to allow for repairs, maintenance, or the introduction of new facilities or services.

Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.

All content included on the website, such as text, graphics, logos, icons, images, data and software, is the property of nabu baby, its affiliates or its content suppliers and is protected by UK and International copyright laws.

You must not use any part of the materials on our website for commercial or other purposes without obtaining written consent from nabu baby.

4. Payment methods

Purchases may be paid for by using a debit or credit card through Sagepay our online payment facility. All prices are in pounds sterling (£), and are payable in pounds sterling (£), plus any applicable taxes.

5. Refusal of Transaction

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing any transaction after processing has begun.

6. Discount Codes

We may at times offer discounts to our customers or on some of the products featured on nabu.co.uk. In this case, you will be requested to enter a code at checkout and to update your basket accordingly. Your discount will be automatically applied to your shopping total. Discount codes may be used alongside special offers on the website. However, you may only use one discount code per order.

7. Delivery Arrangements

Your shopping basket on the website displays the goods you have chosen, the seller who will supply them and details of delivery. The delivery costs for each seller may vary according to the delivery methods they offer. Any delivery times quoted are estimates only, based on availability and normal delivery time in working days.

Each order is sent directly from the individual seller who created it, this means that you may receive more than one package depending on the total number of sellers that you have purchased from.

9. Availability of Goods

Goods may become unavailable or out of stock at any time during the users access of the website. We provide no guarantee that a product will be available when you are ready to purchase.

Any item purchased but found to be out of stock or temporarily unavailable will always be refunded. We may contact you at this time to offer you alternative suggestions.

10. Description of Products and Pricing

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system but since many products are handmade or low volume goods we cannot guarantee that this information will not change.

11. Links

You may link to any page on our website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.

The website provides links to other websites for your information. We have no control over such sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

In the event of such a breach, your right to use our website will cease immediately and the breach will be reported to the relevant authorities.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it.

If you breach these Terms & Conditions and we do not take immediate action, we will still be entitled to use our rights and remedies relating to the initial breach and any other situation where you breach these conditions.

14. The Agreement

These Terms & Conditions and any document expressly referred to in them represent the agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

15. Force Majeur

We will not be held responsible for any delay or failure to comply with our obligations where a seller is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, strikes or other labour disputes (whether or not relating to the seller’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials the date of delivery shall be postponed for the period that the circumstances continue.

16. Law and jurisdiction

Contracts for the purchase of goods through our website will be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
